WebsiteRiskScan.com provides an AI-assisted website analysis tool that reviews publicly accessible websites for potential risk indicators across categories including but not limited to:

• Accessibility and ADA-related issues
• Privacy policy and cookie consent practices
• TCPA-related form language and lead capture practices
• Page speed and mobile usability factors
• Trust signals and conversion-related indicators

The Service generates a report summarizing identified areas of potential concern and recommended improvements. Reports are delivered via email to the address provided at the time of submission.

3 Eligibility

You must be at least 18 years of age and have the authority to submit a website URL for analysis. By submitting a URL, you represent and warrant that you have the right to request an analysis of that website, whether as the owner, operator, or authorized representative.

You may not submit URLs for websites you do not own or have authorization to analyze. Unauthorized submission of third-party URLs may violate applicable laws and these Terms.

4 Not Legal Advice

THE SERVICE DOES NOT CONSTITUTE LEGAL ADVICE. Nothing in the reports, recommendations, or communications generated by WebsiteRiskScan.com should be construed as legal advice, and no attorney-client relationship is formed by your use of the Service.

All findings and recommendations are informational in nature only. You should consult a qualified attorney licensed in your jurisdiction before making any decisions based on the results of a scan or any communications from WebsiteRiskScan.com.

5 No Compliance Guarantee

WebsiteRiskScan.com does not guarantee that your website is compliant with the ADA, WCAG, TCPA, CCPA, GDPR, or any other law, regulation, or standard. The Service identifies potential risk areas based on automated and AI-assisted analysis, which may be incomplete, inaccurate, or outdated.

A passing scan result or positive report does not mean your website is legally compliant. Regulatory requirements vary by jurisdiction, industry, and context. We make no representation that use of our Service or implementation of our recommendations will protect you from legal liability.

6 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Submit URLs for websites you do not own or are not authorized to analyze
• Use the Service to harass, stalk, or harm any individual or organization
• Attempt to reverse engineer, scrape, or extract data from the Service in an unauthorized manner
• Submit false, misleading, or inaccurate information
• Use automated means to access the Service without our express written permission
• Resell, sublicense, or redistribute reports without authorization

We reserve the right to suspend or terminate access for any user we determine, in our sole discretion, has violated these Terms or is misusing the Service.

7 Data & Privacy

When you submit a URL and email address, we collect and store that information to generate and deliver your report and to communicate with you about our services. We do not sell your personal information to third parties.

8 Communications & TCPA Consent

By submitting your email address through any form on WebsiteRiskScan.com, you expressly consent to receive electronic communications from us, including your scan report and follow-up emails related to our services.

If you provide a telephone number at any point, you consent to be contacted at that number by email, phone, or text message, including via automated means, regarding your scan results and related services. Message and data rates may apply. You may opt out at any time by replying STOP to any text message or using the unsubscribe link in any email.

We are committed to TCPA compliance. If you have questions about your consent or wish to withdraw it, please contact us at the information in Section 16.

9 Intellectual Property

All content, technology, trademarks, and materials on WebsiteRiskScan.com — including but not limited to RiskBrain™, scan reports, website design, and written content — are the intellectual property of WebsiteRiskScan.com and are protected by applicable intellectual property laws.

Your scan report is provided for your personal, non-commercial use. You may not reproduce, distribute, or publish report contents for commercial purposes without our express written consent.

10 Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the results of the Service will be accurate, complete, reliable, or applicable to your specific situation.

11 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WEBSITERISKSCAN.COM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so the above limitations may not apply to you in full.

12 Indemnification

You agree to indemnify, defend, and hold harmless WebsiteRiskScan.com and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses — including reasonable attorneys’ fees — arising out of or in connection with your use of the Service, violation of these Terms, or infringement of any third-party rights.

13 Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, or misuse of the Service.

Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination — including Sections 4, 5, 10, 11, 12, and 14 — will survive.

14 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Phoenix, Arizona under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
